1. Booking Confirmation & Payment:

   • By booking a charter with Kaotea Charters, you agree to these Terms & Conditions. Bookings are confirmed upon full payment, which serves as your acceptance of our terms. A confirmation email will be sent detailing your charter information.

2. Charter Inclusions:

   • Our charters include private boat hire, customized itineraries, snorkeling gear, fishing equipment, and refreshments. Any additional requests may incur extra charges and must be communicated at the time of booking.

3. Passenger Responsibilities:

   • Passengers are required to adhere to all safety instructions provided by the captain and crew. This includes the correct use of life jackets and snorkeling equipment. Any failure to comply with these instructions may result in termination of the charter without a refund.
   • Health and Fitness: It is the responsibility of the passenger to ensure they are physically fit for activities such as deep-sea fishing and snorkeling. Passengers with existing medical conditions must notify Kaotea Charters prior to the charter.

4. Assumption of Risk:

   • Deep-sea fishing, snorkeling, and other water activities involve inherent risks, including but not limited to, strong currents, rough seas, encounters with marine life, and the possibility of injury or loss of life. By participating in a charter, you acknowledge these risks and agree to participate at your own risk. Kaotea Charters is not liable for any injury, illness, or death resulting from these activities.

5. Liability:

   • Kaotea Charters is not responsible for any loss, theft, or damage to personal belongings during the charter. Passengers are advised to secure their valuables.
   • Indemnity: Passengers agree to indemnify and hold harmless Kaotea Charters, its owners, and employees from any claims, damages, or liabilities arising from participation in the charter.

6. Weather & Safety:

   • The safety of our passengers is paramount. The captain has sole discretion to cancel or modify the itinerary due to unsafe weather conditions or any other safety concerns. In such cases, we will offer a rescheduled charter or a full refund.
   • Kaotea Charters operates under strict safety guidelines, and passengers are expected to respect all safety briefings and protocols.

7. Cancellation & Refunds:

   • Please refer to our Cancellation Policy for details on cancellations and refunds. Refunds are provided under specific conditions, including those related to weather cancellations.

8. Modifications to Bookings:

   • Any changes to bookings must be requested at least 7 days in advance of the charter date and are subject to availability. Late changes may result in additional fees.

9. Acceptance of Terms:

   • By making a payment and booking a charter with Kaotea Charters, you accept and agree to be bound by these Terms & Conditions.

10. Jurisdiction:

    • These terms are governed by the laws of the Cook Islands. Any disputes arising from these terms or your charter experience will be handled within this jurisdiction.

11. Changes to Terms:

    • Kaotea Charters reserves the right to amend these Terms & Conditions at any time. Any changes will be communicated to customers prior to their charter date.
